Changes in the rules for the employment of foreigners come into force in Poland from January 1.
The corresponding draft law has been adopted, in particular, with the aim of bringing the Polish legislation in accordance with the Directive of the European Parliament No. 2014/36 / EC of 26 February 2014 “On the conditions for entry and stay of third-country nationals for the purpose of employment as a seasonal worker”.
Now in Poland the existing system of admission of foreigners to the labor market of the republic is expanding.
The changes concern the issuance of work permits, the introduction of a new type of work permit, which will concern the performance of seasonal work by foreigners.
Permission for seasonal work will be issued at the place of residence or residence of the subject who hires an alien. Work for the holder of such a permit will be no more than 9 months in a calendar year. The same document gives the right to work in Poland for six months over the next twelve months.
Permission for seasonal work will be given if the amount of remuneration specified in the contract with an alien is not lower than the wages of employees performing at the same time the work of the corresponding type or in the same position. At the same time, the employer will be obliged to explain why he employs an alien, and not a citizen of Poland.
